Membership and Eligibility
- Eligibility Requirements: FounderFirst memberships are available to individuals who are at least 16 years old and legally capable of entering into binding contracts. By signing up, you confirm that you meet these eligibility criteria.
- Account Information: You must provide accurate, complete, and up-to-date information when registering for a membership. Failure to do so may result in the suspension or termination of your account.
- Non-Transferability: Memberships are personal to the registered individual and cannot be transferred, shared, or assigned to another person.
- Compliance: By using FounderFirst, you agree to comply with all applicable laws and regulations related to your membership and use of the services.
Membership Plans and Renewals
- Subscription Plans: FounderFirst offers membership plans on a subscription basis, which may vary in duration (e.g., monthly or annually) as specified at the time of purchase.
- Automatic Renewals: All memberships operate on a continuous subscription basis and will automatically renew at the end of each billing cycle unless canceled by the member prior to the renewal date.
- Renewal Notifications: The renewal date for your membership is displayed in your account under the "Subscriptions" section. FounderFirst may send reminders before the renewal date, but it is your responsibility to manage your subscription.
- Cancellation Policy: To cancel your membership and avoid automatic renewal, you must notify FounderFirst before the renewal date. Cancellations can be made through your account settings. No refunds will be issued for unused portions of a billing cycle after a renewal has occurred.
- Pricing Adjustments: FounderFirst reserves the right to adjust membership fees. Any changes to pricing will be communicated in advance and will not affect your current subscription period. Adjusted fees will apply only upon renewal.
By subscribing to a FounderFirst membership, you acknowledge and agree to these terms regarding plans and renewals.
Fees and Payment
- Membership Fees: The fees for FounderFirst memberships are clearly stated at the time of purchase. All prices include applicable taxes, such as VAT, unless otherwise specified.
- Payment Methods: Payments can be made using accepted methods such as debit cards, credit cards, or other approved payment options. By providing payment details, you authorise FounderFirst to charge the applicable membership fee to your chosen payment method.
- Billing Cycle: Membership fees are charged at the beginning of each subscription period (e.g., annually or lifetime) and will automatically renew unless canceled prior to the renewal date.
- Failed Payments: If a payment fails due to insufficient funds, expired payment methods, or other issues, FounderFirst reserves the right to suspend or terminate your membership until the outstanding balance is settled.
- Price Changes: FounderFirst may adjust membership fees at its discretion. Any changes to pricing will be communicated in advance and will take effect upon your next renewal. Current subscriptions will not be affected until the start of a new billing cycle.
- Refunds: Membership fees are non-refundable except where required by applicable law. If you cancel your membership after a payment has been processed, you will retain access to your benefits until the end of the current billing period, but no partial refunds will be issued.
Use of Discounts and Offers
- Access to Offers: FounderFirst provides members with access to exclusive discounts, deals, and offers from participating businesses. These offers are available only to active members with valid memberships.
- Offer Restrictions: Each participating business may have specific terms and conditions regarding the use of their offers. These may include restrictions on:
- Dates and times when the offer is valid.
- Specific products or services covered by the offer.
- Limits on the number of times an offer can be redeemed.
- Non-Combination of Offers: FounderFirst discounts and offers cannot be combined with other promotions, such as student discounts, loyalty rewards, or set menus, unless explicitly stated by the business.
- Availability: Participating businesses may modify or withdraw their offers at any time without prior notice. FounderFirst is not responsible for changes in availability or validity of any third-party offers.
- Misuse of Offers: Any attempt to misuse or fraudulently redeem discounts or offers may result in the suspension or termination of your FounderFirst membership.
Data Usage and Privacy
- Personal Data Collection: FounderFirst collects and processes personal data provided by members during registration and use of services. This includes, but is not limited to, contact details, payment information, and account activity.
- Purpose of Data Use: Your personal data is used to:
- Provide and manage your membership.
- Facilitate access to discounts, offers, and other services.
- Communicate important updates, including membership renewals or changes to terms.
- Send marketing communications, if you have opted in.
- Data Sharing: FounderFirst may share your data with trusted third parties, such as payment processors or participating businesses, solely for the purpose of delivering its services. Your data will not be sold or shared for unrelated purposes without your consent.
- Marketing Communications: By signing up, you consent to receive promotional emails or notifications. You may opt out of marketing communications at any time by using the "unsubscribe" option included in the communication or by updating your account preferences.
- Data Security: FounderFirst takes reasonable measures to protect your personal data from unauthorized access, loss, or misuse. However, no system is completely secure, and you acknowledge that you provide your data at your own risk.

Changes to Terms
- Right to Amend: FounderFirst reserves the right to modify or update these Terms of Service at any time. Changes may be made to reflect updates in our services, legal requirements, or business practices.

- Effectiveness of Changes: Unless otherwise stated, changes to the Terms of Service will take effect immediately upon being published. For ongoing subscriptions, any changes that materially affect your membership will apply at the start of your next renewal period.
Liability
- Service Availability: FounderFirst strives to provide uninterrupted access to its services but does not guarantee that the platform, discounts, or offers will always be available, error-free, or meet your expectations. Temporary interruptions may occur due to maintenance, updates, or unforeseen circumstances.
- Third-Party Offers: FounderFirst acts as an intermediary by providing access to discounts and offers from third-party businesses. However, it does not guarantee the accuracy, availability, or quality of these offers. FounderFresh is not responsible for any disputes or issues arising between members and participating businesses.
- Limitations of Liability: To the fullest extent permitted by law, FounderFirst's liability is limited to the amount of membership fees paid by you during the current subscription period. FounderFirst is not liable for:
- Indirect, incidental, or consequential damages.
- Loss of profits, data, or business opportunities resulting from the use or inability to use its services.
- Changes or withdrawal of offers by participating businesses.
- Member Responsibility: Members are responsible for ensuring compliance with any terms and conditions set by participating businesses when redeeming offers. Misuse of services or failure to adhere to these terms may result in membership termination without refund.
Communication
- Primary Method of Communication: FounderFirst communicates with members primarily through electronic means, including email, notifications on the platform, or other digital channels. By using FounderFirst, you consent to receive communications electronically.
- Membership Notifications: Important updates related to your membership, such as renewal reminders, changes to terms, or billing issues, will be sent to the email address associated with your account. It is your responsibility to ensure that your contact information is accurate and up-to-date.
- Marketing Communications: FounderFirst may send promotional emails or notifications about discounts, offers, or new features. You can opt out of marketing communications at any time by using the "unsubscribe" link provided in the email or by updating your preferences in your account settings.
- Member Inquiries: If you need assistance or wish to contact FounderFirst, you can reach out via the designated customer support email or contact form provided on the website. FounderFirst will make reasonable efforts to respond promptly to all inquiries.
- Legal Notices: Any legal notices or formal communications from you to FounderFirst must be sent via email to the official contact address specified on our website. Such notices will be deemed received only upon acknowledgment by FounderFirst.
Governing Law
- These Terms of Service are governed by South African law. Any disputes shall be subject to the jurisdiction of South African courts.
Entire Agreement
- These Terms of Service constitute the entire agreement between you and FounderFirst regarding your membership and supersede all prior agreements or understandings.
